Questions & Concerns about the recent landscaping guidelines

Why the change?

Actually nothing changed. Our HOA was created in 1981, over the years the interpretation of our documents became blurred and misunderstood. With recent events, the HOA board found it necessary to seek legal council to clarify the responsibilities of the HOA. The result was the maintenance matrix that was mailed out to all homeowners.

What do we do now?

In most cases, nothing. The HOA will mow the lawn, trim the bushes and trees as well as other services to keep our community looking good.

What if I want to change my landscaping?

Many members of our community have expressed an interest in changing the landscaping of their front yard. This was actually one of the biggest driving factors for the board to seek legal definition of maintenance responsibility to the community. The fact that the yard is still the property of the homeowner and improvements to that property adds value. Value that the homeowner can realized as money when they sell their home. To ensure our community maintains a certain level of appearance guidelines have been added. 
Like any other change to the appearance of the property which could be viewed from the street or other properties architectural approval is required prior to making changes. Please keep in mind one persons art could be another person’s eyesore.

Important HOA Information

Homeowners associations are generally very misunderstood and besides having drawbacks if properly run do provide a valuable service.

HOA Basics
The HOA is basically a non-profit entity that is usually set up by the developer to provide ongoing care and maintenance for the community. 

Bylaws are created to regulate how the HOA will be run once the developers have sold the properties to the homeowners. In actuality the homeowners control the HOA and its running through a board of volunteers all of whom must be homeowners. Meetings are held to give non-board member homeowners a chance to give their input on how they want the community run. 

Covenants, Conditions and Restrictions (CC&R’s), The rules and contract between the HOA and the homeowners, our own little constitution. 

Policies are created by the board to adapt to changing circumstances of the community.
Some of them are:
Carport Pedestrian Gate Policy
Fine Policy
RV Lot Policy
Trash Can Policy
These are voted in and out as needed. 

Property Management Company
Since the HOA board consists of all volunteers, most HOA’s hire a property management company to take care of the day to day running of the community. In a lot of cases the HOA is only as good or as bad as the property management company that it hires.
